1. About the Service

OPRAExpress (the "Service") is a paid service that helps users prepare and transmit Open Public Records Act (OPRA) requests to the appropriate records custodian. The Service is operated by OPRAExpress (opraexpress.com). The Service is not a records custodian, not a government agency, and does not represent any government entity.

2. No Legal Advice; No Attorney-Client Relationship

The Service provides document preparation, request routing, and tracking only. Nothing on the Service is legal advice. Use of the Service does not create an attorney-client relationship. An attorney-client relationship arises only upon a signed written engagement agreement executed directly between you and a specific attorney.

3. Eligibility

You must be at least 18 years old to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Accounts and Contact Information

You agree to provide accurate information and to keep it current, and you are responsible for all activity under your account.

Communications. By providing your contact information, you consent to receive transactional and service-related messages by email and (where you opt in) SMS. You can opt out of non-transactional messages at any time.

5. Payment, Fees, and Refunds

• OPRAExpress charges a service fee for filing and tracking each request, or a recurring fee for Subscription plans.
• Agency duplication fees (paper copies, media) are billed at cost when applicable and are not refundable once paid to the agency.
• 100% money-back guarantee. If we fail to deliver, or if you're not satisfied with our service, email support@opraexpress.com within 30 days for a full refund of fees paid to OPRAExpress. Full terms on the Guarantee page.
• Lawful denials under an OPRA exemption are not automatic refunds, but every filer gets a free consultation with an attorney from our partner network to evaluate an appeal.
• Subscription cancellations take effect at the end of the current billing period; pro-rated refunds available on request under the guarantee.

6. Your Content and Responsibilities

• "User Content" means the text of your request, attachments, and any information you submit through the Service.
• You are solely responsible for your User Content, including ensuring it is accurate, lawful, and appropriate to share with a government entity.
• You grant OPRAExpress a non-exclusive, worldwide, royalty-free license to host, process, transmit, and display User Content as needed to operate the Service and fulfill your requests.

7. Request Submission and Delivery

• We transmit your request to the records custodian using contact information we maintain.
• We do not guarantee that any request will be accepted, processed, or fulfilled by any government entity, or that any response will be timely, complete, or accurate.
• You authorize us to receive replies from the custodian on your behalf and to forward them to you.

8. Acceptable Use

You agree not to:

• use the Service for unlawful, harassing, or fraudulent purposes,
• attempt to interfere with or disrupt the Service,
• submit automated high-volume or abusive requests,
• misrepresent your identity or affiliation,
• upload malware or harmful code.

9. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, OPRAExpress disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, OPRAExpress will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, or data. Our total liability for any claim relating to the Service will not exceed the greater of one hundred dollars (USD $100) or the amount you paid to us for the Service in the twelve months before the claim.

11. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws rules.

12. Changes

We may modify the Service and these Terms. If we make material changes, we will update the effective date and provide reasonable notice.
